Cancellation of deferrals and review of critical businesses

The Cabinet of Ministers of Ukraine has decided to temporarily suspend the process of reserving employees at enterprises until 15 November 2024. This decision is aimed at reviewing the list of enterprises and organisations eligible for reservation in order to prevent unjustified deferrals from conscription. This was reported by Glavred.info.

The document, published by The Page, provides for the suspension of the rules governing the definition of enterprises critical to the economy and life support, as well as those that meet the needs of the Armed Forces of Ukraine. The relevantCabinet of Ministers’ Resolution No. 76 will no longer be in force until the inspection is completed.

Ministries to retain powers, but audit continues

Temporarily, regional and central authorities have lost the ability to designate enterprises as critical to the economy or the Armed Forces. However, these powers will remain in the hands of the ministries, which should prepare a new draft law to verify the validity of such decisions. Regional administrations and the Kyiv City State Administration are recommended to include the heads of territorial recruitment and social support centres (TSCs) in the commissions responsible for identifying critical enterprises. The audit of the decisions should be completed by 15 November.

Consequences of unreasonable booking

An important aspect of this decision is that if unjustified reservations of persons liable for military service are found, all deferrals will be cancelled. The Ministry of Economy and the Ministry of Defence have been instructed to jointly prepare a project to verify the validity of reservations and review the list of enterprises.

New booking rules: what has changed since October

On 2 October, Ukraine introduced new rules for booking people liable for military service. From now on, businesses cannot book people who have not updated their details by 16 July 2024, have violated the registration rules or are wanted. If a person liable for military service has applied for a reservation but violations of the registration rules are detected, they may be denied a deferral.

Economic booking: the next step of the government

On 4 October, the government announced its intention to introduce a cost-effective booking model that would give businesses more flexibility in addressing staffing issues during mobilisation. The final decision on this issue is to be made by the Parliament.

The Cabinet of Ministers is currently reviewing the mechanisms for booking employees to ensure a more transparent and fair process. At the same time, the suspension of the reservation until 15 November is an important step to prevent unjustified delays and ensure that the country’s defence needs are met.
