Ukraine’s Armed Forces warn that criminal cases may be opened for manipulation in the information space

The Land Forces of the Armed Forces of Ukraine have issued an official warning that criminal proceedings may be initiated for disseminating false or manipulative information aimed at undermining confidence in state institutions and mobilisation activities. The agency called on citizens and the media to refrain from making unfounded accusations against representatives of territorial recruitment and social support centres (RSCs).

The context of changes in mobilisation policy

Since the new mobilisation rules came into force, which were clarified by the Cabinet of Ministers’ Resolution No. 560 of 16 May 2024, the conditions for conscription have changed significantly. These changes have been the subject of much discussion and speculation, which, according to the Land Forces, often leads to the dissemination of inaccurate information.

The danger of manipulation in the media

The official report states that cases of speculative information being disseminated have recently become more frequent, undermining confidence in the mobilisation process and provoking social tension among the population. The military points out that such actions could lead to disruptions in mobilisation, which is critical to the country’s defence capability.

Importantly, the message emphasises: “Any manipulation of the laws on mobilisation measures or dissemination of false information aimed at undermining state security may result in criminal prosecution.” This also applies to assessments of the actions of the TCC and JVs if they are based not on verified facts but on personal prejudice or vested interests.

Legal implications

Legislative changes introduced to the Criminal Code of Ukraine in 2014 introduced liability for obstructing the lawful activities of the Armed Forces. According to Article 114-1, dissemination of false information or actions aimed at undermining mobilisation activities may be grounds for criminal proceedings.

The Land Forces also stressed that any violations by representatives of the TCC and JV are not ignored and are subject to proper legal assessment, with appropriate sanctions in accordance with applicable law.

A call to the media and citizens

The Land Forces Command called on citizens and media representatives, including bloggers, to use only verified information to avoid manipulation and undermining public trust. This is especially true of information disseminated via the Internet and social media, where distortions and speculation on the topic of mobilisation are most common.

In a time of war, the information front is no less important than combat operations, and attempts to destabilise through false news can pose a threat to national security.
