Supreme Court Decision

The Supreme Court of Israel has ruled on the notorious Sde Teiman prison, requiring it to comply with existing laws regarding the detention of Palestinians suspected of terrorism. According to cursorinfo, the Court did not order the closure of the facility, contrary to the demands of the petitioners.

Petition and Allegations

The petition was filed by several human rights organizations following numerous allegations of mistreatment and human rights violations at Sde Teiman. These accusations involved both the prison itself and the IDF personnel who manage it.

Changes in Detention Conditions

The Supreme Court noted that conditions in the prison have significantly changed since the petition was filed, including a reduction in the number of detainees and improvements to the facility’s physical infrastructure.

Protection of the Rule of Law

“Protecting the rule of law, even during a difficult war, is a clear expression of the difference between a democratic state fighting for its existence and a terrorist organization seeking to destroy it,” stated Acting Supreme Court President Uzi Vogelman.

Investigations and Charges

Vogelman also emphasized that allegations of criminal behavior at Sde Teiman should be investigated. One soldier has been charged with mistreatment in the facility, and five others are under investigation.

Human Rights Violations

Allegations of severe human rights violations at Sde Teiman emerged earlier this year. Media reports and NGOs highlighted instances of excessive physical restraint, limb amputations due to prolonged use of handcuffs, beatings, and neglect of medical needs within the facility.

Soldiers Under Investigation

The five soldiers currently under investigation are suspected of aggravated sodomy (an offense equivalent to rape) as well as other forms of assault and violence against one of the detainees.
